ARTICLE 1 – PURPOSE

The purpose of this document is to present the General Terms and Conditions of Sale (GTCS) of the villa-bastille.com website, which exhibits the works and training courses of Patrick Fouilhoux, painter, residing at 103 av de Saint-Mandé 75012 Paris, Siret: 387 858 194 00039.
The GTC define the rights and obligations of the parties in the context of the online sale of products offered on this website.

On this site, the terms “we”, “us”, “our”, “my” and “mine”, “Patrick Fouilhoux painting studio” refer to Patrick Fouilhoux. We offer this website and all related services to you, the user, subject to your acceptance of all of the “Terms and Conditions of Sale and Use” set forth below.

ARTICLE 2 – PRICE

The prices of our products are indicated in euros, and, unless otherwise indicated, include shipping and handling costs.

If you order from a country other than mainland France, you are the importer of the product(s) concerned.

Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums do not fall under the jurisdiction of Atelier de peinture Patrick Fouilhoux.

You will be responsible for all such costs, both in terms of declarations and payments to the relevant authorities and organizations in your country. We recommend that you contact your local authorities for further information.

All orders, whatever their origin, are payable in euros.

We reserve the right to modify the prices of our products at any time, but the product will be invoiced on the basis of the tariff in force at the time of the validation of the order and subject to availability.

Products remain the property of Atelier de peinture Patrick Fouilhoux until full payment has been received.

We reserve the right at any time to modify or discontinue the Service (or any part or content of the Service) without notice and at any time.

We will not be liable to you or any third party for any price changes, suspension or discontinuance of the Service.

ARTICLE 3 – PAYMENT

The fact of validating your order implies the obligation to pay the indicated price.
Payment is made by credit card using the STRIPE secure payment system.

ARTICLE 4 – ORDER

Contractual information is presented in French and will be confirmed at the latest when your order is validated.

Any order placed on our website implies acceptance of these General Terms and Conditions.

Any confirmation of an order implies your full acceptance of these terms and conditions of sale, without exception or reservation.

All the data provided and the recorded confirmation will constitute proof of the transaction.

You declare that you are fully aware of this.

Confirmation of the order will constitute signature and acceptance of the operations carried out.

A summary of your order information will be sent to your order confirmation e-mail address.

You agree to provide current, complete and accurate order and account information for all orders placed through our store. You agree to promptly update your account and other information, including your e-mail address, credit card numbers and expiration dates, so that we may complete your transactions and contact you if necessary.

We reserve the right not to confirm an order for any reason whatsoever, including supply problems, product unavailability or problems with the order received.

In the event that we modify an order or cancel it, we may attempt to notify you by contacting you at the e-mail and/or billing address/phone number provided at the time the order was placed.

ARTICLE 6 – DELIVERY

Delivery address :
The delivery address may differ from the billing address.
Deliveries are made to the address indicated on the order form.

Buyer’s liability :
In all cases, goods travel at the buyer’s risk, and it is the buyer’s responsibility to make any reservations on the delivery note in the event of shortage or damage.
The delivery note issued by the carrier, dated and signed by the customer upon delivery of the product, shall constitute proof of transport and delivery.
On delivery, the customer must check the contents, conformity and condition of the product(s) before signing the acknowledgement of receipt of the parcel. If any anomalies are found, the customer must refuse delivery of the package or express handwritten, precise and dated reservations. These reservations must be confirmed with the carrier by registered letter with acknowledgement of receipt within three working days of delivery of the package. A copy will be sent to us.

Patrick Fouilhoux’s workshop may not be held liable for breach of contract in the event of :
– late delivery by the carrier
– loss of package by carrier
– force majeure
– total or partial disruption or strike, in particular of postal services and means of transport or communications,
– in the event of flood, fire or war
Patrick Fouilhoux’s liability shall in any event be limited to the amount of the order.

Leave or business travel :
No shipments can be made during periods of absence due to vacations or business travel.

Receipt of goods :
The buyer is invited to send an email to Patrick Fouilhoux: villa.bastille@gmail.com, to confirm receipt and condition of the package.

ARTICLE 7 – RIGHT OF WITHDRAWAL

In accordance with the provisions of article L.121-21 of the French Consumer Code, you have 14 days from receipt of your products to exercise your right of withdrawal without having to justify your decision or pay any penalty.

Returns must be in their original condition and complete (packaging, certificate of authenticity). In this case, you are liable. Any damage suffered by the product on this occasion may defeat the right of withdrawal.

You are responsible for return shipping costs.

If you exercise your right of withdrawal, Atelier de Peinture Patrick Fouilhoux will reimburse the sums paid, within 14 days of notification of your request, by bank transfer or by the same means of payment used to place the order.

(Exceptions to the right of withdrawal: article L.121-21-8 of the French Consumer Code)

ARTICLE 8 – WARRANTY

The products sold are covered by the legal warranty against hidden defects provided by articles 1641 et seq. of the French Civil Code.
In any case, as each piece is a unique artistic creation, it cannot be exchanged or reimbursed under the pretext of non-conformity of dimensions or visual non-conformity.
– With regard to dimensions: a tolerance of variation must be accepted as such. The dimensions given on the site are for guidance only. A variation of a few centimetres can be noticed.
– With regard to visuals: the colors of the photos presented on the site are corrected to reflect the real colors as closely as possible, but they may nevertheless differ in hue from reality. The buyer agrees to accept these tonal differences, and a work cannot be returned under the pretext of differences in color shades between the work shipped and the work viewed on the site.

In the event of a warranty claim, the customer will return the product at his or her own expense, upon written request and acceptance by Patrick Fouilhoux, enclosing the original invoice. Upon receipt and after verification, the product will be reimbursed within 30 days by bank transfer.

ARTICLE 9 – INTELLECTUAL PROPERTY

All elements and works on the villa-bastille.com website are and remain the exclusive intellectual property of Patrick Fouilhoux.

No one is authorized to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, the works or elements of the site, whether software or visual, without the express authorization of the artist.

ARTICLE 10 – APPLICABLE LAW IN THE EVENT OF A DISPUTE

These General Terms and Conditions of Sale and Use are drawn up in the French language and shall be governed by and construed in accordance with the laws of France. In the event of a dispute, the French courts shall have exclusive jurisdiction.

ARTICLE 11 – PUBLICATION ON THE INTERNET

Links may be set up to other websites or other Internet sources. However, as Patrick Fouilhoux is not the publisher of these sites, he cannot control their content and cannot under any circumstances be held responsible for the content of sites accessed in this way, or for any collection and transmission of personal data, installation of cookies or any other process used for the same purposes by these sites.
Patrick Fouilhoux cannot be held responsible for any direct or indirect damage resulting or consecutive to the diffusion by a third person of a virus via our site and likely to infect your computer system or the computer configuration of your computer following your connection to this site, the use of this site, the navigation on this site, the downloading of whole or part of the contents of the site.

ARTICLE 12 – REVALUATION OF CTCS

Patrick Fouilhoux reserves the right to modify these terms and conditions of use and sale at any time.
